Personal data means any information relating to an identified or identifiable natural person; an identifiable natural person is a natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

  1. The controller processes personal data that you have provided to him or personal data that the controller obtained based on the fulfillment of your order:
  • name and surname
  • email address
  • postal address
  • phone
  1. The controller processes your identification and contact data and data necessary for contract fulfillment.

 

III.

Legal basis and purpose of personal data processing

  1. The legal basis for processing personal data is
  • performance of a contract between you and the controller according to Art. 6 para. 1 letter b) GDPR,
  • compliance with a legal obligation of the controller according to Art. 6 para. 1 letter c) GDPR,
  • legitimate interest of the controller in providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6 para. 1 letter f) GDPR,
  • your consent to processing for the purposes of providing direct marketing (especially for sending commercial communications and newsletters) according to Art. 6 para. 1 letter a) GDPR in conjunction with § 7 para. 2 of Act No. 480/2004 Coll., on certain information society services in case no order for goods or services was placed.
  1. The purpose of personal data processing is
  • processing your order and exercising rights and obligations arising from the contractual relationship between you and the controller; when ordering, personal data that are necessary for successful order processing are required (name and address, contact), providing personal data is a necessary requirement for concluding and fulfilling the contract, without providing personal data it is not possible to conclude the contract or fulfill it on the controller's part,
  • fulfilling legal obligations towards the state,
  1. The controller does not engage in automated individual decision-making within the meaning of Art. 22 GDPR.

 

IV.

Data retention period

  1. The controller retains personal data
  • for the period necessary to exercise rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
  • for the period until consent to personal data processing for marketing purposes is revoked, for a maximum of 10 years, if personal data are processed based on consent.
  1. After the expiration of the personal data retention period, the controller will delete the personal data.

Recipients of personal data (controller's subcontractors)

  1. Recipients of personal data are persons
  • participating in the delivery of goods/services/payment processing based on the contract,
  • providing e-shop operation services and other services related to e-shop operation,
  1. The controller does not intend to transfer personal data to a third country (to a country outside the EU) or international organization.

  1. Under the conditions set out in GDPR, you have
  • the right of access to your personal data according to Art. 15 GDPR,
  • the right to rectification of personal data according to Art. 16 GDPR, or restriction of processing according to Art. 18 GDPR,
  • the right to erasure of personal data according to Art. 17 GDPR,
  • the right to object to processing according to Art. 21 GDPR,
  • the right to data portability according to Art. 20 GDPR and
  • the right to withdraw consent to processing in writing or electronically to the address or email of the controller specified in Art. III of these terms.
  1. Furthermore, you have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to personal data protection has been violated, or to turn to the court.

 

VII.

Personal data security conditions

  1. The controller declares that he has adopted all appropriate technical and organizational measures to secure personal data.
  2. The controller has adopted technical measures to secure data repositories and repositories of personal data in paper form
  3. The controller declares that only persons authorized by him have access to personal data.
